GENERAL TERMS OF USE OF THE JYROS TOOL
THE « CNC FUNDING » SECTION FOT THE WEBSITE IS ACCESSIBLE AT www.jyros-jeuvideo.com
APPLICABLES FROM FEBRUARY 10, 2025
Préamble
To support the video game industry’s environmental transition, the “Consortium National du jeu vidéo pour l’Environnement” (National Video Game Consortium for the Environment) has been formed by the Syndicat National du Jeu Vidéo (SNJV) and eight (8) regional associations: Atlangames, Bouftang, Capital Games, East Games, Game In, Game Only, Push Start and SO·Games, to develop, in collaboration with the Syndicat des éditeurs de logiciels de loisirs (SELL), a tool entitled “JYROS”, the first environmental impact calculator dedicated to video game companies.
In accordance with article 122-18 of the CNC’s Règlement général des aides financières (RGA, General Financial Aid Regulation), from March 1, 2025, for all new applications for production aid from the Centre national du cinéma et de l’image animée (CNC), video game industry professionals will be required to submit a provisional and a final assessment of the carbon footprint generated by the production of a video game work.
Carbon footprint calculations must be carried out using tools approved by the CNC, in accordance with the protocol for the approval of tools for calculating the carbon footprint of works set out in CNC Chairman’s decision no. 2024/P/36 dated July 15, 2024, which can be accessed via the CNC Protocol link (hereinafter the “Protocol“). The above-mentioned consortium responded to the call for approval to calculate the carbon footprint of video game works dated July 26, 2024, to propose a dedicated tool entitled “JYROS – CNC Funding“, which was certified by the CNC on February 3, 2025.
Under the conditions set out in the Protocol, the “JYROS – CNC Funding” tool is a free tool for companies in the video game sector, enabling users to measure the carbon footprint of video games, particularly before and after production. The main emission factors and data to be used to establish the carbon footprint of a video game are described in the Protocol, and in particular in the “Socle Commun Etude“, accessible via the Socle Commun CNC link. The “Socle Commun Etude” lists the input data to be collected, associated with a specific unit of measurement and generic emission factors imposed for certain emission sources.
The scope of the carbon footprint taken into account by the “ JYROS – CNC Funding ” tool concerns the video game production phase.
Access to and use of the “ JYROS – CNC Funding ” tool and related services are subject to the present terms and conditions of use and imply the user’s express, prior, full and entire acceptance thereof.
The aforementioned consortium recommends that users keep a printed version of the general terms and conditions applicable at the time of use of the aforementioned tool and services for their personal records.
Article 1 : Définitions
In the context of these general terms and conditions of use, the terms used below have the following meanings, whether used in the singular or plural:
“Account”: refers to the User’s account, created under the conditions set out in article 6 of the General Terms and Conditions of Use, accessible from the Website and enabling Users to access the Tool and Services. The Account is specific to each User and can only be accessed by means of his/her Login details;
“General Terms of Use”: refers to the present general terms of use applicable to the Tool, the Services and the Website;
“Consortium”: refers to the “Consortium National du jeu vidéo pour l’Environnement“, made up of eight (8) regional associations, namely Atlangames, an association loi 1901 registered with the RNA under no. W442006099, headquartered at 28 Boulevard Benoni Goullin, Nantes (44200), le Collectif Bouftang association loi 1901 registered with the RNA under n° W9R4003397 having its head office located at Parc de l’Oasis, Rue du Huit Mars in Le Port (97420), Capital Games association loi 1901 registered with the RNA under n° W751164892 having its head office located at Le Cargo, 157 Boulevard Macdonald in Paris (75019), East Games, association under local law (Bas-Rhin, Haut- Rhin et Moselle) registered in the Sirene database since April 22, 2016 under SIREN n°822860953 having its head office located at 7 Avenue de Blida in Metz (57000), Game In, association loi 1901 registered in the RNA under n° W595015257 having its head office located at La Plaine Image, 99 C Boulevard Constantin Descat in Tourcoing (59200), Game Only, association loi 1901 registered with the RNA under n° W691099805 having its registered office at 2 Rue Bonnefoi in Lyon (69003), Push Start, association loi 1901 registered with the RNA under n° W343018201 having its registered office at Halle Tropisme, 121 Rue de Font-Couverte in Montpellier (34070) and SO·Games association loi 1901 registered with the RNA under n° W332004183 having its registered office at CCIB – Service DDP/US, 12 Place de la bourse in Bordeaux (33000) ; and the Syndicat National du Jeu Vidéo (SNJV) SIREN no. 509632964, headquartered at 10 Rue de Penthièvre, 75008 Paris.
“Login details”: refers to the User’s email address, as well as the confidential code or password enabling the User to access his/her Account
“Tool”: refers to the tool entitled “ JYROS – CNC Funding “, which is a CNC-certified tool for calculating the projected and/or actual carbon footprint of a video game. The calculation methods differ according to the phase in which the video game is produced (a priori, in the forecast phase, or a posteriori after the video game has been produced); the data required to produce these two types of footprint being of a different nature. The tool is available free of charge. In particular, the tool includes all data, databases, IT components, graphics (including projects, models and prototypes), infrastructure and content (including texts, still and moving images, videos and databases) belonging to the Consortium.
“Privacy Policy”: refers to the personal data privacy policy accessible via the “Privacy Policy” section of the Website ;
“Services”: refers to all the services offered by the Consortium through access to the Website and enabling Users, once they have created an Account, to use the Tool.
“Website”: refers to the website accessible at the following address: http://www.jyros-jeuvideo.com and from which Users can access the Tool and Services
“Smartphone”: refers to smart cell phones that enable access to websites via an Internet network;
“Tablet”: refers to touch screens used to access websites via an Internet network;
“User”: refers to any individual or legal entity, regardless of where they are located and how they connect to the Tool, acting as a professional in the video game industry, who has created an Account in a professional capacity and who accesses the Tool, Services and Website.
Article 2: Purpose – Enforceability
The purpose of the General Terms of Use is to :
– define the terms and conditions under which Users access the Tool and/or Services,
– set out the terms and conditions applicable to any action taken by Users via the Tool and/or Services.
The General Terms of Use are systematically brought to the attention of Users. They apply exclusively to all use of the Tool and Services and prevail over all other conditions, with the exception of those expressly accepted by the Consortium. Consequently, all other conditions are binding on the Consortium only after written confirmation by the Consortium.
IMPORTANT: NOTE TO USERS
THE USER IS PRESUMED TO KNOW AND ACCEPT, WITHOUT RESERVATION, THE GENERAL TERMS OF USE BY THE MERE FACT OF CONNECTING TO THE WEBSITE AND/OR USING THE TOOL AND SERVICES.
ANY USE OF THE TOOL AND SERVICES IMPLIES THE USER’S EXPRESS, PRIOR, FULL AND ENTIRE ACCEPTANCE OF THE GENERAL TERMS OF USE. BY CHECKING THE BOX: “I have read and
accept the general terms of use – CNC funding” AND ACCEPTING THEM WHEN CREATING THE ACCOUNT, USERS ACKNOWLEDGE THAT THEY ARE BOUND BY THE ENTIRE GENERAL TERMS OF USE.
Article 3: Application / modification of the Terms of Use
3.1- The Consortium reserves the right to modify the General Terms of Use at any time, in particular to take into account any legal, jurisprudential, editorial, functional and/or technical evolution of the Tool and/or Services. In particular, the CNC may, at any time, check the Tool and request that adaptations be made to the Tool, which may require a modification of the General Terms of Use. In addition, the Protocol may itself evolve, in particular to adapt to European work on the methodology for calculating the carbon footprint of video games, thus requiring modification of the present Terms and Conditions.
The prevailing version is that which is accessible online on the day of use of the Tool and/or Services. Any use of the Tool and/or Services by Users after publication of the amended General Terms and Conditions of Use implies their acceptance of the new General Terms and Conditions of Use.
3.2- The General Terms of Use are updated regularly. Consequently, Users are invited to consult them each time they connect to the Tool and/or Services.
3.3- In the event that Users do not agree with the General Terms of Use, they must cease to access the Tool and Services.
Article 4: Benefits of the Tool and Services
The Tool enables Users to calculate the carbon footprint of a video game company, according to the criteria established by the Protocol, in the forecast phase and after the video game has been produced. In order to standardize calculation methodologies between tools, the Protocol has drawn up a list of input data to be collected, associated with a specific unit of measurement and generic emission factors imposed for certain emission items, in the Common Base Study accessible via the CNC Socle Commun link. As such, all the impact factors used in the Tool come from sources that comply with the Protocol.
The purpose of the Tool is to encourage Users to set up action plans to reduce the carbon footprint of their video games, as part of a process of continuous improvement and the fight against climate change.
In this respect, the Consortium makes every effort to provide accurate, relevant and intelligible information. However, the Website, the Tool and/or the Services are not intended to replace the services and the professional advice required for this type of process.
The provision of carbon footprint calculation results by the Tool in no way implies that Users will obtain the CNC production grants requested.
Users are solely responsible for their use of the Tool and Services and assume all direct or indirect consequences of the use of the results and generally of the information obtained from the Tool and Services.
Article 5: Conditions precedent to use of the Tool and Services
5.1– Use of the Tool and Services implies that Users:
have a secure Internet connection, in particular in the case of wireless access, Users must activate the most reliable technical means of security offered by their access provider.
have a valid e-mail address.
have a computer, smartphone and/or tablet connected to an Internet network.
access the Tool and/or Services via the Website.
create an Account as described in article 6 of the General Terms of Use.
5.2– Users warrant that they have full legal capacity to use the Tool and Services, and in particular:
for individuals, be eighteen (18) years of age or older.
for individuals, to be legally capable and have full possession of their intellectual or cognitive faculties (and in particular not to be in a state of dependence, under guardianship and/or curatorship, etc.).
not to be a competitor of the Consortium and/or not to use the Tool and Services to compete with the Consortium, fraudulently and/or in such a way as to harm the Consortium’s interests.
have not already had their Account deleted by the Consortium due to non-compliance with these Terms and Conditions of Use.
5.3– Users undertake to use the Tool and the Services personally for their own professional needs when applying for CNC production grants, which since March 1,2025 have been subject to the submission of a double carbon footprint. Users acknowledge that they are competent to use and access the Tool and Services.
5.4– The Consortium may not be held liable in the event of use of the Services by people who do not meet the conditions set out in articles 5.1 to 5.3 of the General Conditions of Use.
Article 6: Account creation
6.1– To access the Tool and Services, Users must create an Account. A User undertakes to create only one Account in his or her name.
In order to create their Account, Users must visit the Website.
Users can then create an Account by:
filling in a valid e-mail address,
creating a unique and personal password enabling them to access their Account and thus the Tool and Services,
filling in a first and last name,
filling in a company name.
The Account is opened upon successful validation of the registration form.
6.2– The Consortium encourages Users to use “strong” passwords, combining numbers, letters and symbols as well as upper- and lower-case letters.
Users are solely responsible for protecting their Login Details. In this respect, Users undertake to keep them secret and not to divulge them in any form whatsoever. If any part of the User Login Details is lost or stolen, the User must immediately inform the Consortium, which will then cancel and/or update the User Login Details concerned.
The User is entirely responsible for safeguarding the confidentiality of the password entrusted to him/her. In this respect, it is the User’s responsibility to ensure, at the end of each session, that he/she has effectively disconnected from the Website, particularly when accessing the Website from a public computer.
If the User loses his/her password, he/she can request a new password through his/her Account by clicking on the “password recovery” link.
Once an Account has been created, Users will be able to access the Tool and Services.
The User may modify his or her Account at any time by clicking on the “modify profile” and/or “change password” tabs.
Users undertake to provide true, accurate, up-to-date and complete information, in particular concerning their identity. Consequently, they undertake not to create a false identity likely to mislead the Consortium or third parties, and not to usurp the identity of another natural person.
As the Consortium has no control over the accuracy or reliability of the information provided by Users, it cannot under any circumstances be held responsible for the consequences resulting from the provision of incomplete or erroneous information.
In the event that Users provide information that is false, inaccurate, erroneous, out of date, incomplete, misleading or likely to mislead, the Consortium may, immediately and without notice or compensation, delete the fraudulent Account and refuse access, temporarily or permanently, to the Tool and Services.
At any time they deem appropriate, registered Users may decide to delete their Account in accordance with the terms and conditions set out in article 17 of the General Terms of Use.
6.3– In the case of multiple productions and/or studio services, the Tool, in compliance with the Protocol, provides for different accesses in order to guarantee the confidentiality of non-disclosure of data between Users of the same game depending on the organizational teams (e.g. production teams, studio teams, other external service providers, etc.).
Article 7: Tool scope
The scope applicable to the Tool is defined by the Protocol according to various mandatory parameters.
7.1- “Phases” scope
7.1.1- Data
In application of the Protocol, the Tool enables the carbon footprint of a video game to be calculated in two different ways: a calculation during the forecast phase, and a calculation after the video game has been produced. The data required to produce these two types of footprint are different in nature: data derived from a predictive assessment (a priori) and data collected for a completed work (a posteriori).
7.1.2- Typology of works covered
The works covered by the Tool are exclusively video games using different techniques (2D, 3D, real-time 3D or other), formats (console, computer, mobile or other), and genres (action and/or adventure game, role- playing game, puzzle game, management game (strategy, simulation) or other). Immersive works (such as works using virtual reality headsets) or works using “stop motion” technology are excluded from the scope of the Tool.
7.1.3- Phases
The Tool takes into account only the following phases of video game design and creation as defined by the Protocol:
Pre-production: phase of preparation for the production of the video game concerned. It involves finding the technical, human and financial resources needed to produce the video game.
Production: the manufacturing phase of the video game concerned. It includes storyboarding, creation of reference elements, modeling, rigging, set-up, debugging, texturing, shading of characters, sets and props, volume creation, lay-out, set execution, animation, volume and mocap filming, scanning and colorization, rendering and lighting, special effects simulation, compositing and title work on computer machines, as well as the interpretation phase.
Post-production: the follow-up phase of a video game after production. It involves assembling the various elements of the video game (images, visual effects, sounds, music, etc.).
Online follow-up: phase of monitoring the video game after its release. It includes patches and fixes.
The Tool therefore does not take into account the distribution, broadcasting, communication, use and end-of-life phases of a video game. However, the Consortium urges Users to find out more about the environmental impact of these phases and emissions by consulting the digital impact studies available at https://jyros-jeuvideo.com/ressources.
7.1.4- Geographical zones
The geographical scope of the Tool is France, including overseas territories.
7.2- “Activités” scope
In accordance with the Protocol, the Tool takes into account the mandatory activities determined by the Protocol, the results of which are presented by the Tool under the heading “Complete results”.
7.3- “Socle commun” scope
In compliance with the Protocol, the Tool takes into account the mandatory emission items listed for calculating the annual carbon footprint of the company(ies).
The Tool takes into account the mandatory emission items for calculating the carbon footprint of video game manufacturing over its entire creative life.
The Tool indicates incomplete items by an insert showing the percentage of form completion and provides a box to allow the User to explain the reasons for the missing data and prove his inability to collect the information.
The level of requirement in terms of the type of data collected (physical or monetary) for each emission item covered by the “Socle commun” for each of the phases (forecast phase and actual phase) is specified in the “Socle commun” accessible via the CNC Socle commun link.
The method for allocating the studio’s annual emissions for each emission item to each video game manufactured during the year is described by the Tool in a methodological guide accessible via https://jyros- jeuvideo.com/wp-content/uploads/2023/11/JYROS-Guide-methodologique.pdf, in both the forecast and completed phases.
Article 8: Terms and conditions of use of the Tool and Services
8.1- Use of the Tool and Services
8.1.1- Use of the Tool
Once logged in to their Account, Users are invited to click on various headings to obtain the annual carbon footprint of the site of the company(ies) involved in the manufacture of the video game.
Users are invited to create a “CNC Report” for the game project in question via the “CNC Funding” button. This “CNC Report” allows them to fill in the “General Information” required by the CNC on the game project and to add various “Local” forms in order to calculate the project’s carbon footprint during its whole production phase.
The “Premises” forms are completed by selecting the option “CNC grant application (production grant)” and answering various questions in different sections:
Energy.
Business travel and commuting habits.
Fixed assets (IT equipment, real estate and company vehicles).
Purchases of products and services (food, office consumables, services, by-products, advertising).
IT purchases and services (data hosting, consumables, software).
Waste.
Users can use a dedicated field to explain the absence of certain data.
Once this information has been filled in, Users must click on the “Validate” button to validate the form. The form cannot be validated until all the mandatory data defined in the Protocol has been entered (or its absence justified) by Users. A percentage of completion indicates which data remains to be filled in. Once validated, the form becomes read-only and can no longer be modified by the User.
In accordance with the Protocol, once this questionnaire has been completed and validated by Users, they will have access to a presentation of the results of the annual carbon footprint of the video game’s production phase in graphical form, with:
The result of the team’s carbon footprint over one year in tCO2e linked to the production of the work for which CNC grant is requested.
A presentation of the team’s carbon footprint by emission item, using terminology adapted to the video game industry.
A presentation of the most emissive items, broken down by sub-item.
A presentation of the team’s carbon footprint by emission item according to regulatory classifications of GHG (greenhouse gas) emissions:
Regulatory French BEGES, most up-to-date version available.
GHG Protocol.
Once all the “Premises” forms have been validated and consolidated in the dedicated “CNC Report”, users have access to the carbon footprint of the video game’s production phase over its creation period, consolidating the results of each participant in the video game’s manufacture (production teams, studios, other service providers, etc.).
8.1.2- Calculation Method approved by CNC

8.1.3- Using the “CNC Reports” section to export the carbon footprint report for each video game and generate a report identification number
Once logged in to their Account and having entered their Identifiers, Users are invited to click on various sections, including the “CNC Reports” section.
In the “CNC Reports” section, Users can export the carbon footprint of the video game’s production phase according to the model, scope and format (.xlsx) defined by the CNC in an unmodifiable version, by clicking on the “Download” button.
To export the carbon footprint results, Users must first close the file by clicking on the “Validate” button. It will then be impossible to go back to the entry for any corrections.
Users will be able to save the carbon footprint of the video game’s production phase and send it to the CNC via their application form.
The Tool will create an identification number for the carbon footprint results specific to each carbon footprint results, enabling the CNC to ensure that it has been correctly carried out. This identification number will also enable the CNC’s Direction des études, des statistiques et de la prospective to access, via the CNC administrator interface (as described in article 9 herein), a global extraction of data from all carbon footprints carried out by Users for the attention of the CNC.
8.2- User support
The practical terms and conditions of use of the Tool and Services are accessible by consulting the Tool user guide available at https://jyros-jeuvideo.com/ressources/ and/or via training courses given to Users in person and/or as part of webinars and/or via videos/tutorials accessible at https://bertieformation.com/jyros/.
The Consortium offers Users a help center for any difficulties or questions they may have regarding the Tool in:
sending an e-mail to the address of their regional contact, a list of whom is available at www.jyros- jeuvideo.com,
filling in a form accessible by clicking on the “Need Help” tab after logging in via the Account.
8.3- Raising awareness of energy and climate change issues
Articles in various forms (editorial, report, interview, brief, etc.) as well as videos may be broadcast via the Website in order to raise Users’ awareness of energy and climate issues.
In particular, they are created and produced by the Consortium or any other external party, and made available to Users, who can then access them.

THE CONTENTS PUBLISHED ARE THE EXCLUSIVE PROPERTY OF THE CONSORTIUM AND/OR THEIR AUTHORS AND/OR THE CONSORTIUM’S PARTNERS, AND THEIR DISTRIBUTION VIA THE INTERNET SITE MAY UNDER NO CIRCUMSTANCES BE CONSIDERED AS THE GRANTING AND/OR ASSIGNMENT OF ANY RIGHTS WHATSOEVER TO USERS. CONSEQUENTLY, USERS UNDERTAKE NOT TO INFRINGE THE RIGHTS OF THE OWNERS OF SUCH CONTENT, IN PARTICULAR BY REPRODUCING IT IN WHOLE OR IN PART.
8.4- Other Services
Users have the option of storing the information generated by the Tool (data, results, reports) for a period of twelve (12) months, which is hosted in France by the Consortium via Scaleway Dedibox.
Article 9: CNC administrator Interface
Users are informed that the Tool provides specific access for the CNC via a dedicated administrator interface. This interface has two purposes. It allows the CNC to:
verify the existence of video game carbon footprints filed with the CNC by checking declarations using the identification number created by the Tool
retrieve carbon footprint data for all video games over specific periods. Global exports only concern carbon footprint assessments carried out using the method approved by the CNC; assessments carried out outside the approved method, if any, are not included in the data available to the CNC.
The CNC’s Direction des études, des statistiques et de la prospective can access via the CNC administrator interface a global extraction of data from all carbon footprints made by Users for the attention of the CNC. This global extraction is intended solely for the CNC, which undertakes to use this data in compliance with the RGPD. The CNC processes the data for study purposes as part of the mission assigned to it as provided for in the Cinema Code (Article L 111-2).
Article 10 : DURATION OF ACCESS TO THE WEBSITE, TOOL AND/OR SERVICES
The Consortium makes every effort to ensure that the Website, the Tool and/or the Services are accessible seven (7) days a week and twenty-four (24) hours a day, this being an obligation of means only, subject to any breakdowns and maintenance work and any necessary updates.
However, the Consortium cannot guarantee operation and access to the Website, Tool and/or Services 7 (seven) days out of 7 (seven) and twenty-four (24) hours out of twenty-four (24) due to the nature of Internet access and operating elements independent of the Consortium or resulting from cases of force majeure as defined in particular by case law.
The Tool and Services are accessible for the duration of the User’s registration until such time as the User decides to delete his or her Account in accordance with article 17 of the General Terms of Use and/or in the event of an interruption as provided for in article 11 of the General Terms of Use.
Article 11: Interruption of the Tool, Website and/or Services
11.1- The Consortium reserves the right to interrupt the operation of all or part of the Tool, the Website, and/or all or part of the Services any time, with or without notice, in particular in order to ensure corrective and evolutionary maintenance of the latter, or to develop their content or presentation. Insofar as possible, the Consortium will inform Users prior to any major corrective or evolutionary maintenance operation.
Furthermore, Users acknowledge that the Tool, Website and/or Services may be interrupted for reasons beyond the Consortium’s control, and that the Consortium cannot therefore guarantee uninterrupted access to the Tool, Website and/or Services. In this respect, the Consortium cannot be held liable in the event of unavailability of the Tool, Website and/or Services, and if Users are refused CNC production assistance for failure to submit the required carbon footprint.
In any case, the Consortium cannot be held responsible for any interruption and/or malfunction of the Tool, the Website and/or the Services, whatever the cause.
11.2- Users are invited to inform the Consortium of any technical problems they encounter while browsing and/or using the Tool, Website and/or Services by writing to the following address and describing the problem encountered: jyros.contact@gmail.com.
Article 12: General commitments of Users – Restrictions
12.1- In general, Users agree to comply with all the General Terms and Conditions of Use and all applicable laws and regulations. Users are responsible for the use of the Tool, the Website and/or the Services in general, and for the consequences thereof.
12.2- When using the Tool, the Website and/or the Services, Users undertake in particular to:
Provide accurate, complete and realistic data and update them systematically in the event of changes.
Respect the preconditions for use.
Respect the General Terms and Conditions of Use.
Respect the image and reputation of the Consortium and its members.
Not create or attempt to create false Accounts.
Not modify or alter all or part of the Tool, the Website and/or the Services.
Not restrict their use by any means whatsoever and not falsify any statement or element.
Not distribute or attempt to distribute computer viruses or any other harmful elements through them.
Not break into a computer system, alter its contents or commit any of the offences punishable under articles 323-1 and 323-7 of the French Penal Code (“hacking”), or send unsolicited bulk messages, a practice punishable under article 226-18 of the French Penal Code.
Not copy their content and database, especially with the help of automated programs.
Not attempt to recreate all or part of the Tool, the Website, and/or the Services using reverse engineering techniques.
Not give their personal password to a third party.
Not use them for purposes contrary to the rules in force and infringe the rights of third parties (in particular intellectual property and respect for privacy)
More generally, to report any content that does not comply with the Consortium’s respect policy, and/or that is suspicious and/or illicit. Not use the Website, the Tool and/or the Services for commercial purposes.
Not distribute all or part of the Website, the Tool and/or the Services, and in particular the content, on any other medium, without the prior written authorization of the Consortium.
Respect other Users.
More generally, not harm the Consortium and/or any User.
12.3- The Consortium reserves the right to cancel a User’s Account and/or access to the Website, Tool and/or Services without prior notice and without prejudice to any other rights and actions to which the Consortium may be entitled in the event that the User uses the Website, Tool and/or Services in an inappropriate manner.
12.4- The use by Users of images of the Tool, logos associated with the Tool, visuals or animations of the Tool; or any other element of intellectual property protected, owned or controlled by the Consortium (collectively, the “Tool Elements”) as part of any communication, sponsorship, advertising, promotion or marketing operation with a third party is prohibited.
12.5- The Website, the Tool and/or the Services may offer links or applications to other websites or other sources of information managed by partner sites. Insofar as the Consortium cannot exercise control over these partner services and external sources, the Consortium informs Users that it makes no commitment as to the availability and content of these sites and external sources, and declines all responsibility for the content, advertising, products, services or any other material available on or from these sites or external sources.
The Consortium also accepts no responsibility for any damage or loss, whether actual or alleged, arising out of or in connection with the use of, or reliance on, the content, goods or services available on these partner services or external sources.
Article 13: Users liability
13.1- Users are solely responsible for choosing to use the Website, the Tool and/or the Services and for ensuring that they are suited to their needs, that their computer systems are secure and that their data is backed up.
In addition, they are personally responsible for their use of the Website, the Tool and/or Services, as well as for the information they provide, in particular when creating their Account and using the Tool and/or the Services.
13.2- Users guarantee and indemnify the Consortium against any damage suffered by the latter and against any liability action brought against it on the basis of the violation of the General Conditions of Use and/or any right of a third party. In the event of serious fraud, the Consortium reserves the right to communicate all necessary information to the competent bodies responsible for combating such fraud and infringements.
13.3- In the event of a breach by a User of any of their obligations under the General Terms and Conditions of Use, and in particular those set out in article 12 above, the Consortium reserves the right to suspend or terminate the User’s Account without prior notice, under the conditions set out in article 17 of the General Terms and Conditions of Use. Such termination shall be without prejudice to any damages that the Consortium may claim in compensation for loss suffered as a result of such breaches by the User.
Article 14: Liability of the CONSORTIUM – Warranties granted by the Consortium
14.1- Liability
14.1.1- Use of the Tool, Website and/or Services is at the User’s own risk.
Users are solely responsible for the use of the Website, the Tool and/or the Services and their suitability for their needs, as well as for securing their computer network and backing up their data.
Users act under their sole responsibility in their dealings with third parties in connection with the use of the Website, the Tool and/or the Services. Under no circumstances shall the Consortium be held liable for any obligation of result attached to the provision by the Consortium of the Website, the Tool and/or the Services. Under no circumstances may a User who is refused production grant from the CNC seek to hold the Consortium or any of its members liable.
14.1.2- The Consortium may not be held liable for any prejudice suffered by Users as a result of abnormal use of the Website, the Tool and/or the Services, and in particular in the event of violation of the General Conditions of Use.
14.1.3- The Consortium may not be held liable for any direct or indirect damage, loss or expense resulting from the use of the Website, the Tool and/or the Services, or from the impossibility of using them, or from malfunction, interruption due to maintenance, technical failure of the server or related to an interruption in Internet access or for any other cause, a virus, or a line or system problem.
The Consortium may not be held liable for any damage to Users’ computer systems, loss of data, or any other damage resulting from Users’ access to or use of the Website, the Tool and/or the Services.
Furthermore, the Consortium cannot be held liable to Users, to the maximum extent permitted by current legislation applicable in France, for:

the inability of Users to securely and confidentially store a password or the information communicated when creating an Account.
14.2- Warranties
USERS UNDERSTAND AND ACCEPT :

THAT IT IS THEIR RESPONSIBILITY TO TAKE ALL APPROPRIATE MEASURES TO PROTECT THEIR DATA AND/OR SOFTWARE FROM CONTAMINATION BY ANY VIRUSES CIRCULATING THROUGH THE TOOL AND/OR SERVICES (SERVERS, ETC.).
IN PARTICULAR, THAT THE CONSORTIUM DOES NOT GUARANTEE:
THAT THE WEBSITE, TOOL AND/OR SERVICES MEET USER EXPECTATIONS.
THAT THE WEBSITE, THE TOOL AND/OR THE SERVICES WILL OPERATE WITHOUT INTERRUPTION, IN A SECURE MANNER OR WITHOUT OPERATING ERRORS.
THAT THE RESULTS OBTAINED FROM THE DATA COLLECTED BY THE VARIOUS SECTIONS OF THE TOOL ARE COMPLETE, EXHAUSTIVE, VERIDICAL, ACCURATE AND RELIABLE.
No information or advice provided by the Consortium to Users in connection with the use of the Tool and/or the Services shall be considered as the granting of a warranty. The Consortium rejects all representations and warranties, whether express, implied, tacit or statutory, which are not expressly stipulated in the General Terms of Use.
Article 15: Personal data
In accordance with the French Data Protection Act no. 78-17 of January 6, 1978, as amended, and Regulation (EU) 2016/679 on the protection of individuals with regard to the processing of personal data and on the free movement of such data (RGPD), Users are informed that the Consortium automatically processes their personal data for the purposes of using the Tool and Services when creating an Account.
The personal data collected to create an Account includes the User’s surname, first name, company and e- mail address. This information is required to access the Tool and Services. They are kept for as long as the management of the Account requires this personal data. The recipients of this personal data are the Consortium’s employees.
Each User has the right to access, modify, rectify, limit, port and delete data concerning him or her, as well as the right to object. Users are reminded that for rectifications and updates of data relating to their Account, they make the necessary modifications and deletions directly on their own Account.
Users are invited to consult the “Privacy Policy” section available on the Website https://jyros-jeuvideo.com/politique-de-confidentialite/, which details the conditions under which the personal data of Tool Users is collected and processed by the Consortium.
Article 16: Duration and termination of the General Terms and Conditions of Use
16.1- Duration
Access to and use of the Website, the Tool and the Services offered by the Consortium are valid for an indefinite period from the creation of the User’s Account, unless terminated by the User or by the Consortium as provided below.
16.2- Termination of the General Terms and Conditions of Use
16.2.1- The General Terms of Use are valid and apply for as long as Users use the Website, the Tool and the Services.
16.2.2- Users may withdraw from the General Terms and Conditions of Use either (i) by notifying the Consortium at any time by e-mail to the following address: jyros.contact@gmail.com or (ii) by deactivating their Account under the conditions described in article 17 below.
16.2.3- The Consortium may terminate the General Conditions of Use binding it to Users at any time, without notice, in the following cases:
Users fail to comply with one or more of the terms of the General Terms of Use.
The Consortium is obliged to do so by applicable law and/or by the CNC and/or any competent administrative authority.
Such termination may, at the Consortium’s discretion, result in the deletion of the User’s Account, with the same consequences as those set out in article 17 below.
The Consortium also reserves the right to temporarily block access to the Tool and/or Services for Users who have breached the General Terms and Conditions of Use.
Article 17: Account deletion
17.1- Users’ Accounts remain active as long as they are registered on the Website.
As soon as the User deletes his/her Account, and/or the Consortium blocks it, access to the Tool and Services is deactivated.
17.2- Users may delete their Account on the Website at any time, without giving any reason.
To do so, they can go directly to their Account and delete it.
The deletion of an Account entails the definitive and irretrievable deletion of all the information it contains.
17.3- Deletion of an Account does not prevent Users from re-registering and creating a new Account.
17.4- In the event of non-compliance with the obligations arising from acceptance of the General Conditions of Use, provision of incorrect information when creating an Account, or acts likely to harm the interests of the Consortium, the latter reserves the right to delete the User’s Account without any claim for damages.

Article 18: intellectual property
18.1- The Consortium grants Users, on a personal basis, the non-exclusive and non-transferable right, free of charge, for the duration stipulated in article 16, to use the Tool, it being specified that they are prohibited – directly or indirectly – from copying, modifying, creating a derivative work, reversing the design or assembly, selling, assigning, sub-licensing or transferring in any way whatsoever any right pertaining to the Tool.
Users undertake not to modify the Tool in any way and/or not to use modified versions of the Tool, in particular (without this list being limitative) with a view to obtaining unauthorized access. In particular, Users agree not to access the Tool and Services by any means other than the Website.
Users are informed and acknowledge that the Tool may contain confidential information or information protected by applicable intellectual property or other laws. The Intellectual Property Elements are made available to Users, free of charge, for the duration of article 16, for the sole use of the Tool, the Website and/or the Services and within the framework of normal use of their functionalities and in compliance with the present.
The present authorization to use the Intellectual Property Elements is made on a personal, non-exclusive, free and non-transferable basis. The Consortium may revoke this authorization to use the Intellectual Property Elements at any time.
Users are prohibited – directly or indirectly – from copying, modifying, creating a derivative work, selling, assigning, sublicensing or transferring in any way whatsoever any rights pertaining to the Intellectual Property Elements. Users undertake not to modify the Intellectual Property Elements in any way.
In the event of non-conforming or abusive use of Intellectual Property Elements, the Consortium reserves all rights to put an end to the infringement of its intellectual property rights and to delete and/or deactivate Users’ Accounts under the conditions of article 17.4 above.
Article 19: Miscellaneous
19.1- The General Terms and Conditions of Use constitute the entire agreement between the Users and the Consortium with respect to the use of the Tool and Services and the Website in general.
19.2- In general, if one or more stipulations of the General Terms and Conditions of Use are held to be invalid or declared as such in application of a law, regulation or following a final decision of a competent court, the other stipulations will retain all their force and scope and will remain valid and applicable. The same principles shall apply in the event of incomplete provisions.
19.3- The fact that the Consortium does not avail itself, at a given time, of one of the present provisions of the General Conditions of Use, cannot be interpreted as a waiver of the right to avail itself of any of the present conditions at a later date.
Article 20: Applicable law
The use and operation of the Tool, Services and/or Website are subject to French law. The validity, execution and interpretation of the applicable General Terms of Use are also subject to French law.

ALL DISPUTES RELATING TO THE APPLICATION, INTERPRETATION OR EXECUTION OF THE GENERAL TERMS AND CONDITIONS OF USE, AS WELL AS TO THE USE AND/OR OPERATION OF THE TOOL AND/OR THE SERVICES, OR THOSE ARISING THEREFROM OR AS A CONSEQUENCE THEREOF, SHALL, IN THE CASE OF LEGAL ENTITIES, BE SUBJECT TO THE JURISDICTION OF THE COURTS OF LYON (FRANCE), EVEN IN THE EVENT OF A WARRANTY CLAIM OR MULTIPLE DEFENDANTS.
